Legal Definition and Related Resources of Conveyance

A mode by which property is conveyed or voluntarily transferred from one person to another by means of a written instrument and other formalities. It also signifies the instrument itself. Includes every instrument which transfers an interest in or creates a charge of lands. A conveyance can also take place independent of the will and intention of the grantor , and in such case is known as a conveyance by matter of record as in an order of court vesting title to property in the plaintiff . In relation to registration of documents, statutory definition may extend the meaning of the word conveyance to mortgages and judgments. In Putnam Sand and Gravel Co. v Albers, 92 Cal. Rptr. 636, 14 C.A.3d 722, it was held that a lispendens is a conveyance within such statutory definition.The term conveyance is strictly applicable only to a transfer of title to or interest in real property from a living person to another. See In Re Loes’ Will, 55 N. Y.S.2d 723.

It is a general term, and comprehends the several modes of passing title to real estate. 54 Miss. 90. Every instrument in writing by which any estate or interest in land is created, aliened, or mortgaged, or by which the title to land may be affected at law or in equity, except lost wills and testaments, leases for not to exceed three years, and executory contracts for the purchase or sale of land. 1 Rev. St. N. Y. p. 762, § 38.

Transfer of title to realty; and, the instrument by which this is done. To “convey” real estate is, by an appropriate instrument, to transfer the legal title from the present owner to another. Edelman v. Yeakel, 27 Pa. 29 (1856).

English Legal System: Conveyance

In the context of the English law, A Dictionary of Law provides the following legal concept of Conveyance :

1. a. A document (other than a will) that transfers an interest in land. To convey a legal estate in land, the conveyance must be by deed. b. Transfer of an interest in land by means of this document.

2. Any vehicle, vessel, or aircraft manufactured or subsequently adapted to carry one or more people. It is a statutory offence (and also an *arrestable offence), punishable by up to six months’ imprisonment and a fine, for anyone to take a conveyance for his own or someone else’s use (albeit temporary) without permission or to drive or be transported in a conveyance knowing that it has been taken without authority.
