Meaning of Imperfect Mortgage

The term has been sometimes used to denote the legal title which a vendor holds under an unexecuted contract for the conveyance of land upon payment of the purchase money , in which case the vendor’s interest in the land is nothing more than a security ; but the security is said to be stronger than a mortgage , because the lega! title is retained as security. See Gessner v Palateer, 26 P. 789, 89 Cat. 89.
