Meaning of Constructive
Used in contrast to the word actual ; a fiction . That which the law deems or construes as existing; a right , liability or status without reference to the intention of the parties . Thus, constructive trust arises when a stranger to a trust already constituted is held by the court to be bound in good faith and in conscience by the trust in consequence of his conduct and behavior . Such conduct or behavior the court construes as involving him in the duties and responsibilities of a trustee , although but for such conduct and behavior he would be a stranger to the trust.
Constructive Alternative Definition
