Meaning of Judgment In Rem

A judgment pronounced upon the status of some particular subject matter or rendered in a proceeding instituted against property or brought to enforce a jus in re. Thus a judgment of adjudication in bankruptcy is a judgment in rem since it determines the status of the bankrupt . Affects the interest of all persons in designated property provided there has been at least constructive notice to adverse claimants to appear and maintain their rights before the judgment is given. See Hassallv Wilcox, 130 U.S. 493, 9S.Ct. 590, 32 L.Ed. 1001. A judgment in rem is limited to the property in question and does not impose a personal liability on the property owner . See Shaffer v Heitner, 433 U.S. 186, 97 S. Ct. 2569, 53 L. Ed.2d 683.
