Meaning of Carrier
A person holding himself out to transport goods and persons for hire. Carriers are of two kinds, common and private. A common carrier is one who invites all and sundry to employ him without reserving to himself the right of accepting or rejecting their offers of goods or persons for carriage . He is a person who undertakes for hire to transport from place to place persons or goods of all such persons as think fit to employ him for a consideration . Whether a transportation agency is a common carrier depends not upon its corporate charter or declared purpose but on what it does. U.S. v California, 297 U.S. 175, 80 L.Ed. 567, 56 S.Ct. 421. A private carrier, on the other hand, is one who undertakes to transport people or to carry goods in a particular case, but is not engaged in the business of so carrying as a public employment and does not undertake to carry goods for persons generally. The standard of care imposed on a common carrier is higher than that imposed on a private carrier. The obligations and liabilities of a common carrier do not depend upon contract . English Legal System: Carrier
In the context of the English law, A Dictionary of Law provides the following legal concept of Carrier :
One who transports persons or goods from one place to another. Carriage is normally under a contract that may affect or limit the duties otherwise imposed bylaw, but such contracts may be subject to statutory control. Carriers of goods are bailees of the goods consigned.
A common carrier is one who publicly undertakes to carry any goods or persons for payment on the routes he covers. A common carrier is subject to three common-law duties:
(1) he must, if he has space, accept any goods of the type he carries or any person;
(2) he must charge only a reasonable rate; and
(3) he is strictly liable for all loss or damage to goods in the course of transit (but see inherent vice). All other carriers are private carriers, and they owe only a duty of reasonable care.
