Meaning of Special Verdict
As contrasted with a general verdict which is the final statement by the jury as to the truth of the matter submitted to their determination and at issue between the parties , a special verdict is one where the jury gives a determination of the facts without reference to their relation to any issue between parties and upon which findings, the court is to declare the law arising thereon. In such a verdict the jury gives the findings upon the facts as they find them to be proved and pray the advice of the court thereon, concluding conditionally that on the whole matter should the court be of the opinion that the plaintiff has a cause of action , then they find for the plaintiff; if otherwise , for the defendant . See Mumford v Wardwell, 73 U.S. 423,18 L.Ed. 756. The purpose of a special verdict is to test the validity of a general verdict by determining whether all facts essential to its support are established to the satisfaction of the jury. See Cembrook v sterling Drug, Inc., 231 Cal.App.2d52, 41 Cal.Rptr. 492.
Special Verdict Alternative Definition
In practice. A special verdict is one by which the facts of the case are put on the record, and the law is submitted to the judges, as where the jury instead of finding for either party, find and state all the facts at issue, and conclude conditionally, that if upon the whole matter thus found, the court should be of the opinion that the plaintiff has a good cause of action, they then find for the plaintiff, and assess his damages; if otherwise, then for the defendant. 129 111. 142.
