Meaning of Inevitable Accident

In the case of a collision of vessels, one which a party charged with an offense could not possibly prevent by exercise of ordinary care, caution and maritime skill. To constitute inevitable accident it is necessary that the occurrence should have taken place in such a manner as not to have been capable of being prevented by ordinary skill and ordinary prudence; one is not to expect extraordinary skill or extraordinary diligence , but that degree of skill and that degree of diligence which is generally to be found in persons who discharge their duty. where a collision occurs after both parties have endeavored by every means in their power , with due care and caution, and a proper display of nautical skill to prevent the occurrence of the accident, that is an inevitable accident. An act of god without the intervention of man; some casualty which human foresight could not discern, and from the consequences of which no protection could be provided . The term is also synonymous with unavoidable accident .

Inevitable Accident Alternative Definition

A term used in the civil law, nearly synonymous with fortuitous event. 10 Miss. 572. Any accident which cannot be foreseen and prevented. Though used as synonymous with “act of God,” it would seem to have a wider meaning, including not only accidents resulting from natural forces, but those originating from human agencies. 4 Doug. 287, 290, per Lord Mansfield; 21 Wend. (N. Y.) 198, per Cowen, J.; 3 Blackf. (Ind.) 222; 2 Ga. 349; 10 Miss. 572; 1 Pars. Cont. 635; Whart. Neg. 553. In the Law of Maritime Collisions. Inevitable accident, “an occurrence which the party charged with the collision could not possibly prevent by the exercise of ordinary care, caution, and maritime skill.” 2 Wall. (U. S.) 550.
