Meaning of Third Party

A person who is not a party to the transaction or proceeding in question . In practise , third party procedure is resorted to by a defendant against a person who is not a party to the action in circumstances where the defendant claims (a) contribution from such third party in respect of anyjudgment that may be recovered against the defendant; and (b) indemnity from such third persons in respect of such judgment ; or (c) where he seeks to have the findings upon the issues as between himself and the plaintiff to be binding upon such third party. The defendant’s right to invoke the third party procedure exists whenever the plaintiffs claim against the defendant, if successful, will result in the defendant having a claim against the third party to recover from him the amount of the judgment which he has been compelled to pay to the plaintiff. Where the dispute is between a fit parent and a private third party, however, both parties do not begin on equal footing in respect to rights to ‘care, custody, and control’ of the children. The parent is asserting a fundamental constitutional right. The third party is not. A private third party has no fundamental constitutional right to raise the children of others. Generally, absent a constitutional statute, the non-governmental third party has no rights, constitutional or otherwise, to raise someone else’s child. McDermott v.
