Recent Possession

Legal Definition and Related Resources of Recent Possession

Meaning of Recent Possession

The term denotes the principle of evidence that property recently stolen found in possession of a defendant gives rise to the presumption that the defendant is guilty of theft . A relative term and whether or not theft is recent depends upon the nature of the property, the facility of its handling and transfer and other factors. See Robinson v state , (Fla.App.) 257 So.2d300. However, it is said that the presumption or inference of guilt weakens as the period after theft lengthens. See U.S. v Coggins, (C.A. D. C.) 433 F.2d 1357.
