Meaning of Counterclaim

A cause of action asserted by one or more defendants against one or more plaintiffs. An affirmative effort to enforce or collect upon an affirmative claim . As such it is different from a set off or recoupment . It is not a defense on the merits but is an independent cause of action and must be complete within itself. Helle v Brush, 275 N. E.2d 688, 2 III. App.2d 951.
