Meaning of Collateral Estoppel
A branch of the broader law of res judicata which bars litigation of any issue or fact actually determined in a prior action , generally between same parties involving a different claim or cause of action . City of Hackensack v Winner, 392 A.2d 187, 162 N.J. Super 1. In order to raise this doctrine it is necessary that the prior adjudication should have resulted in the identical issues being distinctly raised and actually litigated. Collateral Estoppel Alternative Definition
The collateral determination of a question by a court having general jurisdiction of the subject. See 26 Vt. 209.
