Meaning of Patents

The rights granted to an inventor under federal Statutes relating to patents, to exclude others from making, using or selling the patented device . Confers a statutory monopoly protecting the patentee against unlicensed use of the patented device or process . See Sears, Roebuck & Co. v Stiffel Co., 376 U.S225, 84 S. Ct. 784, 11 L.Ed.2d 661. A patent is a species of property , which is incorporeal and personal , the jurisdiction over which follows the person of its owner . See De La Vergne Refrigerating Mach. Co. v Featherstone, 147 U.S. 209, 13 S.Ct. 283, 37 L.Ed. 138. Also see, 35 U.S.C.§261.
