Meaning of Jurisdiction

The extent of legal authority and power . A term of large and comprehensive import , it generally denotes the lawful authority of a body to exercise power. The term also denotes the territorial limits of the Sum total of sovereign ‘s judicial power . Alamida v Wilson, 495 P.2d585,53 Haw. 398. In a limited sense, the term relates to the right to entertain a particular case within a class of cases. Far lev v Farley, 300 N.E.2d 375, 157 Ind.App.385. Jurisdiction is said to be of t.r.e. kinds, of the subject matter, of the person and to render particular order or judgment . See Farrer v Moore, (Mo.App.) 416 S. IV. 2d 711. Jurisdiction may be exclusive or concurrent . It is exclusive when proceedings in respect to certain subject matters can only be brought in one particular court ; that court then has exclusive jurisdiction. It is concurrent when the proceedings can be brought in any one of several courts.

early 14c., jurisdiccioun, jurediction, etc., “administration of justice,” from Old French juridicion (13c., Modern French juridiction) and directly from Latin iurisdictionem (nominative iurisdictio) “administration of justice, jurisdiction,” from phrase iuris dictio, genitive of ius “law, right” (see jurist) + dictio “a saying” (see diction). Meaning “extent or range of administrative power, domain over which a legal or judicial authority extends” is from late 14c. Meaning “judicial authority, right of making and enforcing laws” is from early 15c. The form in English assimilated to Latin 16c. Related: Jurisdictional.

The following is a definition of Jurisdiction, produced by Tetley, in the context of admiralty law: A term referring to the nature and extent of the legal authority bestowed upon a legislature to enact laws (legislative jurisdiction) or of courts to hear and determine actions and other legal proceedings (judicial jurisdiction), as determined by international conventions or national laws. A court exercises its “jurisdiction” (i.e. decision-making authority, or “competence”) over proceedings of certain types (“subject-matter jurisdiction”, or “jurisdiction ratione materiae”) and over a defined territory (“territorial jurisdiction”, or “jurisdiction ratione loci”). Its authority to adjudicate may also be limited to certain persons or to certain maximum amounts of money in dispute. “Jurisdiction” may also refer to one or more States or political subdivisions governed by a particular legal system (e.g. “common law jurisdictions”, “civilian jurisdictions”). The term may also refer to the type of legal proceedings whereby a court assumes and exercises its decision-making function (e.g. the court’s “in personam” or “in rem” jurisdiction (see this maritime law term in this legal dictionary)). “Jurisdiction” may be used with respect to a particular type of subject-matter jurisdiction exercised by a court (e.g. the “Admiralty jurisdiction” of the Court of Queen’s Bench), as well as with respect to the geographic limits of the territorial jurisdiction of the court (e.g. service “out of the jurisdiction”; assets “within the jurisdiction”).
