Meaning of Naked
in addition to the ordinary meaning of nude, the word in law means bare, involving no active duties, such as a naked or passive trust ; powers that are personal to a person , such as a trustee , which can not be exercised by the court or a successor. See Yates v Yates, 255 III. 66, 99 N.E. 360; Fontain v Ravenal, 58 U.S. 369, 15 L.Ed. 80. Such powers are also called in this context personal or confidential powers, such as the discretion granted by a testator to a trustee to name a beneficiary . See Sheridan v Krause, 161 Va. 873, 172 S.E. 508. Also, without consideration , as in the term naked promise to pay, which is unenforceable for lack of consideration. See Puerto Rico industrial development Co. v John H. Miller Mfg. Corp., (D.C.IIL) 170 F.Supp. 918.
