Meaning of Judicial Sale
A sale made under judgment or order of court of competent jurisdiction by officers legally appointed and commissioned to sell. In such a sale, the court is the vendor and the officer a mere ministerial agent. McNeil v Fouts, (Ind.App.) 218 N.E.2d 138.
Judicial Sale Alternative Definition
A sale, by authority of some competent tribunal, by an officer authorized by law for the purpose. In a strict sense, an execution sale is not a judicial sale (18 Vt. 394), but it is generally so regarded (66 Ind. 505).
