Meaning of Judgment On Merits

As distinguished from a judgment by confession or one by default , a judgment on merits is one which amount to a decision as to respective rights and liabilities of parties based on ultimate facts or state of facts disclosed by pleadings or evidence or both and on which right of recovery depends, irrespective of formal, technical or dilatory objections or contentions. See Litton v Cole, 203 N.E.2d590, lll.App.2d 161.
