Meaning of Judgment Nil Dicit

A form of default judgment and is granted where a defendant fails by his pleas to answer the whole or any separable portion of any substantial allegation of a declaration in which case the plaintiff may have judgment nil dicit after so much of the declaration or complaint as is not covered by the plea. The term is also applied to a judgment given where a defendant having pleaded abandons the plea or his plea is struck out or withdrawn and no further defense is made. See Grand Lodge Brotherhood of Railroad Trainmen v Ware, (Tex. Civ.App.) 73 S. W.2d 1076.
