Meaning of Illegitimate Children

An illegitimate child is a child born of parents who are not legally married. If a child is born to a married woman, and is actually the offspring of her sexual intercourse with someone other than her husband, the law presumes that the child is legitimate as it is still the offspring of the woman who is legally married. See Dazeyv Dazey,50 Cal.App.2d 15,122 P.2d 308. This presumption can be rebutted by showing that the husband had no access to his wife at the probable time of conception . Most states by statute provide for the legitimation of a child born to an unmarried couple, on the couple marrying after the birth of a child.
