Meaning of Confess, Confession

An acknowledgement in express words by the accused in a criminal case of his guilt of the crime charged or of some essential part thereof. A voluntary statement made by one who is the defendant in a criminal trial at a time when he is not testifying in that trial, by which he acknowledges certain conduct of his own that constitutes a crime for which he is on trial; a statement which, if true, discloses his guilt of that crime and excludes the possibility of a reasonable influence to the contrary. People v’ Wozniak, 45 Cat. Rptr. 222, 235 C.A.2d243.
