Meaning of Wilful

That which is intentional or deliberate. That which is done knowingly, voluntarily. The word must be read in the context in which it appears as it may mean one thing in civil prosecutions and another in criminal prosecutions. Wilson v. U.S., (C.A.9.) 250 F. 2d 312. Generally, the term refers to exercise of conscious, intentional, knowledgeable or voluntary act as distinguished from inadvertent act. Newsome v. U.S., (D.C.Te.x.) 301, F.Supp. 757. The doing of an unlawful act with knowledge that that act is unlawful and with intent to do such act. See Babb v. U.S., (C.A.5.) 252 F.2d 702.
