Meaning of War

A state of armed conflict between two or more nations. That state in which a nation prosecutes its rights by force. See Prize Cases 2 Black 635, 17 L. Ed. 459. In the United States the power to make war is vested in the Federal Government, with congress having the power to declare war. Hamilton v Dillin, 21 Wall.73, 22 L.Ed. 528. However it has been held that participation in war can be achieved by a congressional declaration of war or by a specific notification of executive actions. See Da Costa v Laird, (C.A.2d) 448 F.2d 1368, cert.denied, 405 U.S. 979.

War Alternative Definition

War is a hostile contest with arms between two or more states or communities claiming sovereign rights. Field, Int. Code, p. 467. Classification :
(1) War is either offensive, defensive, or auxiliary. The distinction between offensive and defensive war has been based on the provocation leading to the war, but this test is difficult of application. The most practical test is as to the belligerent in whose territory the war is waged. See Glenn, Int. Law, 169. An auxiliary war is one undertaken by a third nation in support of a belligerent.
(2) War is either public or private, accordingly as it has or has not the sanction of the sovereign power of the state. A insurrectionary war in which one party to a gnvernment, and the other is not, htts been called “mixed war.”
(3) War is either perfect (sometimes called “solemn”), or imperfect (sometimes called “unsolemn”), accordingly as it has been declared in due form by the sovereign power, or is limited as respects places or persons. 25 Wend. (N. Y.) 483.
(4) War is either foreign or civil, according as it is between independent states, or between a state, as such, and a party or section of its own subjects. Civil war is distinguished from a mere treasonable insurrection only by degree, “by the number, power, and organization of the persons who originate and carry it on.” 2 Black (U. S.) 635.

Etimology of War

late Old English wyrre, werre “large-scale military conflict,” from Old North French werre “war” (Old French guerre “difficulty, dispute; hostility; fight, combat, war;” Modern French guerre), from Frankish *werra, from Proto-Germanic *werz-a- (source also of Old Saxon werran, Old High German werran, German verwirren “to confuse, perplex”), from PIE *wers- (1) “to confuse, mix up”. Cognates suggest the original sense was “to bring into confusion.” Spanish, Portuguese, and Italian guerra also are from Germanic; Romanic peoples turned to Germanic for a “war” word possibly to avoid Latin bellum (see bellicose) because its form tended to merge with bello- “beautiful.” There was no common Germanic word for “war” at the dawn of historical times. Old English had many poetic words for “war” (wig, gu_, hea_o, hild, all common in personal names), but the usual one to translate Latin bellum was gewin “struggle, strife” (related to win (verb)). First record of war-time is late 14c. Warpath (1775) originally is in reference to North American Indians, as are war-whoop (1761), war-paint (1826), and war-dance (1757). War crime first attested 1906 (in Oppenheim’s “International Law”). War chest is attested from 1901; now usually figurative. War games translates German Kriegspiel (see kriegspiel).

    Notion of War

    The meaning of War may be as follows: A state of hostilities between or within nation states. In terms of the U.S. Constitution, a state of “war” exists when declared so by Congress. In actual use, nations (including the U.S.) often engage in military action without formally calling those actions war. A similar meaning would be: legitimate use of organized violence or force to achieve “goods” (also see conflict).
