Most jurisdictions have penal statutes empowering the court to require a person to give security against future breach of the peace by him, breach of which security may be punished with imprisonment . It is a form of preventive justice consisting in obliging those persons whom there is a probable ground to suspect of future misbehavior to stipulate with and to give full assurance to the public , that such offense as is apprehended shall not happen . See ex parte Wav, 56 Cal.App.2d 814, 133 P.2d 637.
