In eminent domain proceedings, while the compensation payable to owner for property that has been appropriated, is generally the fair market value of the property, its adaptability for a special purpose or use may be considered as an element of value. See, e.g., Newton Girl Scouts counsel Inc. v Massachusetts turnpike authority , 335 Mass. 189, 138 N.E.2d 769. However, where the land owner puts the property to a special use after receiving knowledge that it is to be condemned, the special use will not be taken into consideration in arriving at the value. See state bv State highway commission v Stumbo, 222 Or. 62, 352 P.2d 478.
