Meaning of Res Gesteae
Matters that are incidental to main fact and explanatory to it, including acts which are so closely connected therewith as to constitute part of transaction and without knowledge of which main fact might not be properly understood. It’s a transaction, occurrence, controversy or matter under investigation, whether or not it is a principal fact bearing on a cause of action or only a collateral or incidental one. See Kornicki v Cahnar S.S. Corp., C.A. Pa. 460 F.2d 1134. The term generally refers to circumstances, facts, and declarations that grow out of main fact, shed light upon it, and tend to explain it, made at a time so near, either prior or subsequent to, main act as to exclude idea of deliberation or fabrication. See Williams v state , 240 S.E.2d890, 144 Ga.App. 130.
