Meaning of Remittitur

The process whereby a verdict of the jury is diminished by subtraction. The term is also used to designate an order of an appeal court denying a defendant ‘s application for new trial on condition that plaintiff consent to a specified reduction in thejury’s award . Also the judgment of the appeal court authenticated to the trial court, communicating an affirmance of the verdict conditional upon the lower court reducing the award. This last definition however has been sometimes disapproved. See Bush Const. Co. v Walters, 164 So.2d 900, 250 Miss. 384.
