Meaning of Consent

The deliberate assent amounting to an active acquiescence . An act of reason, accompanied with deliberation, the mind weighing, as in the balance , the good or evil of either side. To constitute consent, there must be a bargain between two parties . See People v Westek, 109 P.2d9,31 Cal.2d469. In order that there may be true consent, there must be physical and mental power on the party consenting and a free and serious use of them. A consent obtained by fraud , by intimidation , undue influence , etc., is not a true consent. Also, the party consenting must have the capacity to so consent. A consent to carnal knowledge given by a person under age will not constitute a defense to a charge of rape or indecent assault .

Consent Alternative Definition

(Lat. con, with, together, sentire, to feel). A concurrence of wills. Express consent is that directly given, either viva voce or in writing. Implied consent is that manifested by signs, actions, or facts, or by inaction or silence, which raise a presumption that the consent has been given. Consent supposes a physical power to act, a moral power of acting, and a serious, determined, and free use of these powers. Fonbl. Eq. bk. 1, c. 2, §1. See Agree, ment; Contract.

In the context of the English law, A Dictionary of Law provides the following legal concept of Consent :

Deliberate or implied affirmation; compliance with a course of proposed actio Consent is essential in a number of circumstances. For example, contracts and marriages are invalid unless both parties give their consent. Consent must be given freely, without duress or deception, and with sufficient legal competence to give it (See also informed consent). In criminal law, issues of consent arise mainly in connection with offences involving violence and *dishonesty. For public-policy reasons, a victim’s consent to conduct which foreseeably causes him bodily harm is no defence to a charge involving an *assault, *wounding, or *homicide; in other cases the defendant should be acquitted if the magistrates or jury have a reasonable doubt not only as to whether the victim had consented but also as to whether he thought the victim had consented.
