Meaning of Not Guilty
The proper form of plea to a criminal charge for an accused wishing to deny the charge. By such a plea, he is denying the entire case of the prosecution and laying upon it the burden of proving its case. This plea puts in issue all material facts of the case and all of the material facts alleged. commercial credit Co. v Newman, 198 So. 303, 189 Miss. 477. The function of such a plea is to put the government to its proof and to preserve the right to defend and it does not go to prove that a defendant is innocent. See Wood v United States , 128 F.2d265,15 U.S.App.D.C. 274. The verdict of not guilty is simply a verdict of not proven in the particular case tried; not a verdict of innocence. See Roberts v People, 87 P.2d 251, 103 Colo. 250.
