Meaning of Intoxication
In strict sense, the condition or state of being poisoned. However, the most popular and prevalent meaning is the condition induced by excessive drinking of alcohol. Intoxication can be of various degrees. Within penal statutes relating to the offense of public intoxication, the term means impairment of a man’s capacity to think or act correctly and or a loss, in part, of control of his physical and mental faculties due to ingestion of alcohol. See People v Williams, 215 N. Y.S.2d841, 28 Misc.2d 691. In relation to disqualification of employees from benefits under the U nemployment Compensation law, the term has been interpreted to comprehend not only the easily recognized manifestations of excessive drinking but also any abnormal mental or physical condition from overindulgence which deprives an employee of the clarity of intellect or muscular control necessary for the proper performance of his work. See Hassen v Unemployment Compensation board of review , 150 A.2d 158, 189 Pa. Super.386.
