Meaning of Condition Precedent

It is a condition which delays the vesting of a right until an event happens. In real estate law, it is a fact or event which must exist or happen before a right becomes vested. Wein Consolidated Airlines v C.I.R., (C.A.9)528 F.2d 735. In relation to contracts, the term refers to an event or an act which must happen or be performed before a right can accrue to enforce an obligation dependent upon the happening or performance thereof against another in favor of one claiming such right. See Partlow v Matthews, 261 P.2d 394, 43 Wash. 2d 398.
