The definition of Advisory opinion in the law of the United States, as defined by the lexicographer Arthur Leff in his legal dictionary is:
In some states there is a procedure whereby a governmental body, ordinarily the legislature but sometimes the executive, can frame a question of law (usually pertaining to the constitutionality or legal propriety of a contemplated statute) and submit it to the state’s highest court for determination and reply. The U.S. Supreme Court, relying on the “case and controversy” language of Article III, § 2, of the Constitution, decided early that it could not give advisory opinions.
