Meaning of Privacy

Although privacy is a right protected by law, it is incapable of precise definition as it overlays various substantive areas such as constitutional law and torts. The right to privacy is the right to be free from the unwarranted appropriation or exploitation of one’s personality, the publicizing of one’s private affairs with which the public has no legitimate concern, or the wrongful intrusion into one’s private activities, in such manner as to outrage or cause mental suffering, shame or humiliation to a person of ordinary sensibilities. Smith v N.B.C., 138 Cal.App. 2d 807. In constitutional law, it is an individual’s protected right to do certain kinds of actions, e.g., the right to use contraceptive devices. Griswold v Connecticut, 381 U.S. 479, 85 S. Ct. 1678, 14 L.Ed.2d510. Also, see Roe v Wade, 410 U.S. 113, in which the Texas statute limiting right to abortions was struck down as an unnecessary infringement on womens right to privacy. In the law of torts, the right encompasses inter alia protection against public disclo-sure of private facts. See Melvin v Reid, 112 Cal.App. 285, 297 P. 911. Also protection against appropriation of name or likeness. See Carlisle v Fawcett Publications, 201 Cal.App. 2d 733, 20 Cal. Rptr. 405. Also see Namath v Sports Illustrated, 80 Misc.2d 531, 363 N. Y.S.2d276.
