Workers rights in Global Commerce Policy

In this regard, workers rights is: an issue identified by sections of the United States Congress as relevant to the emergence of more equitable trade practices and policies. It is partly based on the view that some governments gain a competitive advantage by denying their workforces the conditions considered normal in the United States. The issue also has a more general human rights dimension. The entries on trade policy are here. In practice the two strands are difficult to disentangle, but for many the human rights aspect is more important. The United States Omnibus Trade and Competitiveness Act of 1988, the Uruguay Round Agreements Act (URAA) and other United States trade laws contain provisions permitting discretionary action, including the withdrawal of GSP benefits, if there is a persistent denial of workers rights. The Omnibus Trade and Competitiveness Act also contains three negotiating objectives which American negotiators must pursue in their trade negotiations. These are (i) promoting respect for workers rights, (ii) ensuring a review of the relationship of workers rights to the GATT and related rules, and (iii) adoption of the principle that the denial of workers rights should not be a means for a country or its industries to gain a competitive advantage in international trade. Section 301 requires USTR to take action if a foreign country shows a persistent pattern of conduct that (a) denies workers the right of association, (b) the right to organize and bargain collectively, (c) permits any form of forced or compulsory labour, (d) fails to provide a minimum age for the employment of children, or (e) fails to provide standards for minimum wages, hours of work, and occupational safety and health of workers. Section 131 of the URAA requires the President to seek the establishment of a working party in the WTO to explore the linkage between international trade and internationally recognized workers rights.
