Meaning of Unconscious

Unaware; the opposite of conscious. A condition in which a person acts without awareness. People v Heffmgton, 107 Cai.Reptr. 859, 32 C.A.3d 1. In penal statutes, the term denotes an act committed by a person who because of somnambulism, a blow on the head, or similar causes is not conscious of acting and whose act therefore cannot be deemed volitional. See People v Sedens, 112 Cai. Reptr. 1, 518 P.2d913.
