Meaning of Unconditional And Sole Ownership

The phrase is used in fire insurance policies and means that the ownership of the property insured against is in those on whom the loss insured against would certainly fall, not as a matter of mere contract obligation, but as a result of real bone fide rights in insured property. See Phoenix Ins. Co. v Hillard, 52 So. 799, 59 Fla. 590. The phrase does not however mean free from encumbrances. See Terminal Ice and Power Co. v American Fire Ins. Co., 194 S. W. 722, 196 Mo.App. 241.
