Meaning of Slander Of Property

The false and malicious statement which tends to disparage the quality , condition or value of the property of another, and which causes him special injury or damage . Such statements are actionable . See national Ref. Co. v Benzo Gas Motor Fuel Co., (C.A.8.Mo.)20 F.2d 673. It should be noted however that a mere criticism of a merchant ‘s wares or products with no intent or purpose of obtaining a competitive advantage will not be construed as slander of property giving rise to a cause of action . See Tex. Smith, Harmonica Man, Inc. v Godfrey, 198 Misc. 1006, 102 N. Y.S.2d251.
