Meaning of Non-conforming Use

In the law of municipal zoning and planning , the phrase denotes a pre-existing use of land that is permitted to continue after the enactment of a zoning ordinance which prohibits the use. Surry v Starkey, (N.H.) 332 A.2d 172; University Park v Benners, (Tex.) 485 S. W.2d 773. A prior lawful use existing at time of a zoning amendment that may be continued after the amendment even if such amendment bans the use. Durham v White Enterprises, Inc., 115 N.H. 645, 348 A.2d 706.
