In this regard, a definition of this issue is as follows: the practice of ascertaining whether qualified local people might be available when assessing whether to suport an application for the employment of foreign nationals. Article XVI of the GATS states, among other things, that in sectors where market access commitments have been made, limitations or numercial quotas may not be maintained or adopted on the total number of persons employed.[1]
