But for test in Global Commerce Policy
In this regard, but for test is: a method adopted by the panel in Canada − measures affecting the export of civil aircraft to establish whether a link existed between a governmental grant to the Canadian regional aircraft industry and anticipated exportation or export earnings . The test asks whether assistance would not have been given but for anticipated exportation or earnings. The panel found that assistance to the Canadian regional aircraft industry constituted export subsidies inconsistent with the Agreement on Subsidies and Countervailing Measures.[1]
