The cure of a defect in a pleading by a verdict at trial. Let us say, e.g., that the plaintiff in a negligence action fails to plead negligence. The defendant, despite every opportunity to do something (e.g., move for dismissal, or judgment on the pleadings) does nothing, and a trial is held at which rafts of evidence of the defendant’s negligence are admitted. The jury finds for the plaintiff. The defendant cannot then try to rely on the original pleading defect. (The modern Federal locus of this wholesome rule is Fed. R. Civ. P. 15.)
