What does Abatable nuisance mean in American Law?
The definition of Abatable nuisance in the law of the United States, as defined by the lexicographer Arthur Leff in his legal dictionary is:
A nuisance which can be eliminated. In fact, of course, all nuisances can be eliminated, if one is willing to pay the cost, including the cost of foregoing the profit from the abated activity. Hence the use of the term “abatable nuisance” often implies that the nuisance at issue could be ended at some reasonable cost, or should be ended at almost any cost, which further implies that a court would or should order its abatement.
