In the law of evidence. A presumption which may be rebutted by evidence. Otherwise called a “disputable” presumption. A species of legal presumption which holds good until disproved. Best, Pres. § 25 ; 1 Greenl. Ev. §33.

In this regard, rebuttable presumption is: a legal term in common use in the United States meaning that an action is deemed to conform with the law until shown otherwise. Some say that the word rebuttable  is redundant since any presumption can be challenged. The term is sometimes used in discussions of the precautionary principle.[1]
