In English law, An ancient military court, possessing both civil and criminal jurisdiction touching matters of arms and deeds of war. As a court of civil jurisdiction, it was held by the lord high constable of England while that office was filled, and the earl marshal, jointly, and subsequently to the attainder of Stafford, duke of Buckingham, in the time of Henry VIII., by the earl marshal alone. It had cognizance, by St. 13 Rich. As a court of criminal jurisdiction, it could be held only by the lord high constable and earl marshal jointly. It had jurisdiction over “pleas of life and member arising in matters of arms and deeds of war, as well out of the realm as within it” It was not a court of record, could neither fine nor imprison (7 Mod. 127), and has fallen entirely into disuse (3 Sharswood, Bl. Comm. 68; 4 Sharswood, Bl. Comm. 268).
