English Legal System: Continental Shelf
In the context of the English law, A Dictionary of Law provides the following legal concept of Continental Shelf : The sea bed and the soil beneath it that is adjacent to the coast of a maritime state and outside the limits of the state’s territorial waters. The 1958 Geneva Convention on the Continental Shelf limits the extent of the shelf to waters less than 200 metres deep or, beyond that limit, to waters that are of such a depth that exploitation of the natural resources of the sea bed is possible. The coastal state is granted exclusive sovereign rights of exploitation over mineral resources and nonmoving species in its continental shelf, provided that this causes no unreasonable interference to navigation, fishing, or scientific research. The 1982 Conference on the Law of the Sea extends the continental shelf, in some cases, to a distance of 200 nautical miles from the baselines around the coast from which the breadth of the territorial sea is measured. It also makes special provisions for delimiting the continental shelf between states with adjacent or opposite coastlines, but does not lay down rules of law for such delimitation. Rocks that cannot sustain human habitation do not have a continental shelf.
