Meaning of Banishment

A punishment inflicted upon criminals, by compelling them to quit a city, place, or country for a specified period of time, or for life. See 4 Dall. (Pa.) 14. It is to be distinguished from “transportation,” which implies a confinement in some place beyond the realm.

What does Banishment mean in American Law?

The definition of Banishment in the law of the United States, as defined by the lexicographer Arthur Leff in his legal dictionary is:

A punishment for crime (or for backing the wrong side in a political upheaval) in which a citizen is sent away from his native land, for a time or forever. See also transportation. It is not a permissible punishment in the U.S. But cf. deportation, i.e., the enforced return of a non-citizen from the U.S. to his country of origin upon proof of fraudulent entry or subsequent crime.
