In civil law. An action adapted to the particular case which had an analogy to some actio in jus, which was founded on some subsisting acknowledged law. Spence, Eq. Jur. 212. The origin of these actions is strikingly similar to that of actions on the case at common law. See “Case.”

A Roman-civil law action adapted to a particular set of facts by means of analogy to an established action. Their similarities to the development of the common law actions on the case have been frequently remarked but, so far as one can tell, the two developments are in detail not all that close.
