Meaning of Act of state

An act done by the sovereign power of a country, or by its delegate, within the limits of the power vested in him. An act of state cannot be questioned or made the subject of legal proceedings ip a court of law.

English Legal System: Act of State

In the context of the English law, A Dictionary of Law provides the following legal concept of Act of State : An act, often involving force, of the executive of a state, or committed by an agent of a sovereign power with its prior approval or subsequent ratification, that affects adversely a person who does not owe allegiance to that power. The courts have power to decide whether or not particular conduct constitutes such an act, but if it does, they have no jurisdiction to award any remedy.
