Commercial policy in Global Commerce Policy
In this regard, commercial policy is: a term now disappearing and in general use being replaced by trade policy with which it has co-existed for decades. The entries on trade policy are here. It covers governmental acts, policies and practices which influence trade in goods and services. The drafters of the GATT thought of commercial policy as the subjects covered in Part II of the GATT which includes, among others, national treatment, anti-dumping and countervailing duties, customs valuation, import and export fees and formalities, marks of origin, quantitative restrictions, subsidies, state trading enterprises, safeguards, and consultation and dispute settlement. Title VII of the Treaty of Maastricht retains the wording “common commercial policy†from the Treaty of Rome which defines it in Article 113 (Article 133 in the amended treaty) as “based on uniform principles, particularly in regard to changes in tariff rates, the conclusion of tariff and trade agreements, the achievement of uniformity in measures of liberalization, export policy and measures to protect trade, such as those to be taken in the event of dumping or subsidiesâ€.
