Meaning of Equitable Estate
An estate or interest in land by operation of equity , such as the estate or title of a person for whose use or benefit lands are held in trust by another, the latter having the legal estate .
Equitable Estate Alternative Definition
A right or Interest in land, which, not having the properties of a legal estate, but being merely a right of which courts of equity will take notice, requires the aid of such court to make it available. These estates consist of uses, trusts, and powers (q. v.) See 2 Bouv. Inst, note 1884. They possess, in some respects, the qualities of legal estates at modern law. 1 Pet. (U. S.) 508; 13 Pick. English Legal System: Equitable Estate
In the context of the English law, A Dictionary of Law provides the following legal concept of Equitable Estate : A right in property recognized by the Court of Chancery, as distinct from a *legal estate recognized in common law courts (See estate). Equitable estates reflected legal interests but could be more flexible (Compare shifting use; springing use). Before 1926, most types of estate could exist either at law or in equity; since 1925 only a limited number of legal estates can exist; all other interests m land are called *equitable interests. The term equitable estate is now technically Incorrect.
