Meaning of Smuggling
At common law , the term signified bringing on shore or carrying from shore of goods , wares and merchandise for which duty has not been paid or goods the importation or exportation whereof was prohibited.The term now generally refers to the act of surreptitiously and by concealment or fraud avoiding customs and introducing goods into the United States . See United States v Clay bourn, (D.C.Cal.) 180 F.Supp. 448. It has been said that an attempt to smuggle i.e., where the goods have not actually been brought into a port of entry, is not within the definition of the term. See Keck v United States, 172 U.S. 434, 19 S.Ct. 254, 43 L.Ed. 505. Where the goods had not passed the t.r.e. mile limit applicable to offshore sea and ocean, and have not yet been landed , the goods are not said to be smuggled. See United States v Ritter- man, 273 U.S. 261, 47 S.Ct. 371, 71 L.Ed. 636.
Smuggling Alternative Definition
The fraudulent taking into a country, or out of it, merchandise which is lawfully prohibited. More specifically, a secret introduction of goods into a state with intent to avoid payment of duty thereon. Bac. Abr.
