Meaning of Search Warrant

A warrant issued under authority of law by a magistrate or Justice of the peace or any person by law empowered to issue the same, directed to a sheriff , constable or other officer commanding the latter to search a specified premises and seize certain specified goods or documents. See Search. except in a few specifically established and well delineated exceptions, which are jealously and carefully drawn, a search and seizure may not be made without a search warrant. See Coolidge v New Hampshire, 403 U.S. 443, 91 S.Ct. 2022, 29 L.Ed.2d 564.

Search Warrant Alternative Definition

In practice. A warrant requiring the officer to whom it is addressed to search a house, or other place, therein specified, for stolen, contraband or illicit property therein, and, if the same shall be found upon such search, to bring the goods so found, together with the body of the person occupying the same, who is named, before the justice or other officer granting the warrant, or some other justice of the peace, or other lawfully authorized officer.
